FDA, Hemp Industry Prepare for Friday Hearing on CBD Regulation

The FDA is weighing decisions on how to classify and regulate products with CBD, a compound in cannabis.

Those in the CBD industry expect that the FDA will eventually allow botanical, non-synthetic CBD to be sold as a dietary supplement and will decide on a dosage limit separating its use as a supplement and its use as a prescription drug. The dosage amount in Epidiolex, the seizure drug, is significantly higher than dosages typically sold in consumer products. "We think that there will be some sort of demarcation line at a certain milligram level, above which it can only be sold as a drug with FDA approval and below which it could be sold as an over-the-counter dietary supplement or food additive," says Jonathan Miller, former Kentucky state treasurer and current general counsel for the U.S. Hemp Roundtable, a coalition of hemp companies. "That number is one of the biggest issues that needs to be determined in this process."
